Pension and Retirement Fraud Victims

Zyprexa, also known as Olanzapine, is manufactured by Eli Lilly & Co. The drug is used in treating schizophrenia and bi-polar disorder. Zyprexa is Eli Lilly's top-selling drug with sales of $2.5 billion in 2002. Zyprexa’s side effects include, but may not be limited to, the onset of diabetes and other serious permanent injury. Certain plaintiffs have reached a settlement with Eli Lilly for over $590 million.

Phenolic Foam Roof Insulation Victims
Phenolic Foam Roof Insulation (PFRI), which was widely used in commercial and institutional buildings from 1980 through 1992, releases an acidic leachate which causes severe corrosion to metal roof decks. In December of 2000 the U.S. District Court in Boston, Massachusetts, after more than five years of major construction defect litigation granted final approval to two settlements with the manufacturers of PFRI. The estimated value of the total settlement compensation is over $350 million.

GILMAN AND PASTOR, LLP announces that a $61.42 million Class Action Settlement has been reached with Cal-Shake, Inc. (“New Cal-Shake) in the Cal-Shake Shakes litigation pending in the Superior Court for Contra Costa County, CA. The New Cal-Shake Settlement Class includes owners of property on which Cal-Shake Shakes manufactured between February 1, 1986 and March 31, 1995 are, or have been installed. The Settlement was reached during trial and was recently granted final approval by the court.

Gilman and Pastor LLP Announces $15 Million Settlement in Securities Fraud Action for Securities Market Manipulation. The firm served as Co-Lead Counsel in In re Blech Securities Litigation, 94-CIV-7696-RWS (S.D. N.Y.) asserting market manipulation claims against the brokerage firm of D. Blech & Co., its principals, its clearing broker, Bear Stearns & Company and several other alleged participants in connection with an alleged scheme to inflate the prices of various biotechnology securities. In a vigorously litigated case, the firm obtained certification of a class of purchasers of 22 separate securities, successfully opposed various motions to dismiss, and, subsequently, motions for summary judgment, and after extensive discovery and trial preparation, negotiated over $15 million in cash settlements on behalf of the class. This case resulted in extremely important reported judicial opinions concerning clearing broker and other liability issues. In re Blech Securities Litigation, 961 F. Supp. 569 (S.D. N.Y. 1997).

GILMAN AND PASTOR, LLP. announces that Johnson & Johnson Settles Patient Propulsid Claims for $90 Million Janssen Pharmaceutica, a Johnson & Johnson company, reached a settlement agreement with the plaintiffs of the Propulsid federal multi-district litigation to resolve all federal lawsuits brought by patients who claimed Propulsid, a heartburn drug that Johnson & Johnson withdrew from the market, caused them heart problems. Prior to the withdrawal, the U.S. Food and Drug Administration warned that Propulsid could cause irregular heartbeats and sudden death. There are approximately 4,000 individuals included in the MDL of whom approximately 300 are alleged to have died from use of the drug. Under the settlement agreement, Janssen could pay patients up to $90 million.
