Carbon Fibers Antitrust Litigation, No. 02-2385A (Middlesex Superior Court, Mass.) Gilman and Pastor served as Lead Class Counsel in the antitrust suit alleging a price-fixing conspiracy by the manufacturers of carbon fiber. After extensive litigation, the firm reached settlements totaling in excess of $2.7 million on behalf of a class of Massachusetts end-users of carbon fiber products.
 
 
Gilman and Pastor represent a class of policy holders of Allstate Insurance Company and Allstate Floridian concerning Allstate’s failure to adequately compensate its insureds for homeowners, property and casualty claims. Allstate has a fiduciary duty to promptly and adequately pay all losses arising from valid claims.
 
 
Transkaryotic Therapies, Inc. Securities Litigation, No. 03-10165-RWZ (D. Mass.), Gilman and Pastor is one of the firms representing the lead plaintiff in a securities fraud case involving the company’s misrepresentations about correspondence from the FDA with respect to prospects for approval of one of the company’s key products. The court has denied the defendants’ motion to dismiss, and the case is now in the discovery phase.
 
 
Brumbaugh v. Wave Systems Corporation, No. 04-30022-MAP (D. Mass.), the firm represents the court-appointed lead plaintiffs. This is a securities case arising out of the company’s misrepresentations and omissions concerning two purported license agreements with major corporations for the company’s digital security products.
 
 
Nationwide class action seeking among other things, remediation of Zonolite Attic Insulation installed in residences. We allege that the insulation contains dangerous asbestos fibers. Zonolite was sold as recently as 1984.
 
 
Zyprexa, also known as Olanzapine, is manufactured by Eli Lilly & Co. The drug is used in treating schizophrenia and bi-polar disorder. Zyprexa is Eli Lilly's top-selling drug with sales of $2.5 billion in 2002. Zyprexa’s side effects include, but may not be limited to, the onset of diabetes and other serious permanent injury. Certain plaintiffs have reached a settlement with Eli Lilly for over $590 million.
 
 
$8.2 MILLION SETTLEMENT REACHED IN MASSACHUSETTS ANTITRUST CASE

Gilman and Pastor, LLP, on behalf of consumers, has reached a settlement with manufacturers of monosodium glutamate (MSG) and nucleotides for participating in an international conspiracy to fix prices and allocate markets of MSG and nucleotides, for in excess of $39 million.
 
 
Gilman and Pastor, LLP represents all Massachusetts consumers who purchased General Motors vehicles, model years 1996 through 2003, that were factory equipped with DEX-COOL engine coolant. We allege that DEX-COOL engine coolant can and has caused rusty sludge to form in the cooling system, clogged the radiator, heater core and hoses, required replacement of the radiator, gaskets and other parts and required the flushing of the engine and heating systems.
 
 
Microsoft Massachusetts Consumer Protection Litigation, No. 00-2456 (Middlesex Superior Court), Gilman and Pastor, LLP was co-lead counsel and obtained a settlement valued at $34 million, which was approved by the Court.
 
 
$22.9 MILLION SETTLEMENT REACHED IN VITAMINS ANTITRUST CASE

Gilman and Pastor, LLP represented a class of Massachusetts consumers in a class action arising from an international conspiracy by vitamin manufacturers to fix the prices of vitamins, vitamin premixes and other vitamin products.
 
 
Gilman and Pastor, LLP has been appointed by the Trial Court in the consolidated Massachusetts Indirect Purchaser Actions. The firm was also appointed by the District Court to the Indirect Purchaser Plaintiffs’ Executive Committee in In re Dynamic Random Access Memory (DRAM) Antitrust Litigation, No. M 02-1486 (N.D. Cal.) and is currently litigating the case on behalf of indirect purchasers nationwide.
 
 
Gilman and Pastor, LLP represents a proposed class of present and retired pilots of Delta Air Lines, Inc., challenging Delta’s methodology of calculating pension insurance benefits for participants in certain Delta retirement plans.
 
 
Nationwide class action among other things seeking recall of tires as well as to recover costs incurred to replace the defective tires.
 
 
Judicial Council Coordination Proceeding No. 4208, (Contra Costa Cty, California Superior Court), the Court granted final approval to a $61,420,000 partial settlement fund for owner’s of properties on which certain manufactured cement composite roofing products were installed. Gilman and Pastor, LLP was one of four firms that represented the class members. After extensive litigation on all fronts, the case was partially settled during trial against certain defendants for over $61 million dollars.
 
 
Phenolic Foam Roof Insulation (PFRI), which was widely used in commercial and institutional buildings from 1980 through 1992, releases an acidic leachate which causes severe corrosion to metal roof decks. In December of 2000 the U.S. District Court in Boston, Massachusetts, after more than five years of major construction defect litigation granted final approval to two settlements with the manufacturers of PFRI. The estimated value of the total settlement compensation is over $350 million.
